Chapter One General Provisions

  The first article is to effectively prevent and control dust pollution, improve the quality of the air environment, protect the health of the public, and promote the construction of ecological civilization, in accordance with the "Air Pollution Prevention and Control Law of the People's Republic of China", "Hebei Province Air Pollution Prevention Regulations" and "Hebei Province People's Congress Standing Committee "Decision on Strengthening the Prevention and Control of Fugitive Dust Pollution" and other laws and regulations are formulated in accordance with the actual conditions of the province. 

  Article 2 These measures are applicable to the prevention and control of dust pollution and its supervision and management activities in the administrative area of ​​this province. 

  Article 3 The prevention and control of dust pollution shall follow the principles of source control, planning first, highlighting key points, combining prevention and control, government leadership and public participation. 

  Article 4 The people's government at or above the county level shall strengthen the leadership of the prevention and control of dust pollution, formulate special plans for the prevention and control of dust pollution, and establish and improve the overall coordination, long-term management and financial investment guarantee mechanism for the prevention and control of dust pollution. 

  Article 5 The competent department of ecological environment shall implement unified supervision and management of the prevention and control of dust pollution within its administrative area. 

  Housing and urban-rural construction, natural resources, transportation, urban management, industry and information technology, agriculture and rural areas, water administration and other departments implement supervision and management of dust pollution prevention and control within their respective responsibilities. 

  Township people's governments and sub-district offices shall do a good job in the prevention and control of dust pollution within their respective jurisdictions, promptly stop the activities of dust pollution when found, and report to the department responsible for the supervision and management of dust pollution prevention and control. 

  Article 6 The competent department of ecological environment shall, in accordance with the special plan for the prevention and control of dust pollution, formulate an overall plan for the prevention and control of dust pollution, and report to the people's government at the same level for approval before organizing its implementation. 

  Other departments responsible for the supervision and management of dust pollution prevention and control shall, based on the overall plan for the prevention and control of dust pollution, formulate their own dust pollution prevention and control work plan, clarify the work objectives, main tasks, completion time limit, etc., and organize their implementation. 

  Article 7 Enterprises, institutions and other producers and operators shall perform their main responsibilities for the prevention and control of fugitive dust pollution, formulate implementation plans for the prevention and control of fugitive dust pollution, implement measures for the prevention and control of fugitive dust pollution, pay environmental protection taxes in accordance with the law, and assume responsibility for the damage caused by pollution in accordance with the law. 

  Article 8 People's governments at or above the county level shall encourage and support enterprises and institutions to develop, promote and apply new technologies, techniques, and equipment for dust pollution prevention and control; encourage and support industry associations to formulate and implement professional regulations for dust pollution prevention and control, and strengthen self-discipline management. 

  Article 9 People's governments at all levels and relevant departments shall strengthen publicity and education on the prevention and control of dust pollution, and promote public participation in the prevention and control of dust pollution. 

  The news media should strengthen public welfare propaganda on the prevention and control of dust pollution, and conduct public opinion supervision on illegal activities of dust pollution. 

Chapter II Prevention Measures

  Article 10 The construction of construction projects shall take effective measures to prevent and reduce dust pollution, and ensure that the discharge of dust pollutants from the construction site meets the national and provincial pollutant discharge standards. 

  The provincial emission standards for dust pollutants are formulated by the Provincial Department of Ecology and Environment in conjunction with the Provincial Market Supervision Administration, and shall be announced to the public after being approved by the Provincial Government. 

  Article 11 Construction projects in urban planning areas shall meet the following dust-proof requirements: 

  (1) Announcement signs shall be set up at obvious locations at the entrances and exits of the construction site to announce information such as the person in charge of the construction site, environmental protection supervisors, dust prevention measures, dust supervision and management departments, and telephone numbers for reporting and complaints;

  (2) Set up a hard enclosed fence or fence around the construction site, the height of not less than 2.5 meters for the main road section, and not less than 1.8 meters for the general road section, and the height of not less than 1.8 meters at the bottom of the fence. 0.2m anti-overflow seat; 

  (3) Harden the entrances and exits of the construction site, construction roads, material processing and storage areas, office areas, and living areas, and keep the ground clean; 

  (4) Set up vehicle cleaning facilities at the exit of the construction site and set up supporting facilities for drainage and mud sedimentation, and the vehicles can be driven out after being cleaned; 

  (5) Where construction materials such as ready-mixed concrete and ready-mixed mortar are used in accordance with regulations and can only be mixed on site, dust-proof measures shall be taken; 

  (6) Where cement, lime, sand, gravel, construction earth and other powdery or granular building materials that are prone to dust are piled on the construction site, dust-proof measures such as airtight or cover shall be adopted, and dust-proof measures shall be adopted when loading, unloading, and handling; 

  (7) Construction waste shall be cleared and transported in time. If it is piled up on the site, it shall be piled up in a centralized manner and dustproof measures such as airtight or cover shall be adopted; 

  (8) Simultaneously install video monitoring equipment and online dust pollutant monitoring equipment at the construction site, and connect to the monitoring equipment of the construction department and the ecological environment department respectively, and ensure the normal operation of the system. Failures should be repaired within 24 hours ; 

  (9) Other dust pollution prevention and control measures stipulated by laws, regulations and rules. 

  People's governments at all levels shall actively promote the prevention and control of dust pollution from the construction of rural construction projects in accordance with the above regulations, and reduce dust pollution. 

  Article 12 In addition to the relevant provisions of Article 11 of these Measures, the construction of house construction projects in the urban planning area shall also meet the following dust-proof requirements: 

  (1) During earthwork construction operations, reasonable control of the excavation and retention time of earthwork should be carried out. Dust prevention measures such as water spraying and spraying should be taken on the work surface. Surface compaction and Covering and other dust-proof measures, bare soil stacked for more than eight hours without disturbance should be covered; 

  (2) The main working layer of the project should be closed with a dense mesh safety net, and kept clean, firm, and undamaged; 

  (3) The building should be kept clean and tidy, and water should be sprayed to prevent dust during cleaning; 

  (4) During high-altitude operations, construction waste should be transported by closed pipelines or bagged with vertical lifting machinery. Throwing or scattering at heights is prohibited; 

  (5) During the decoration construction, dust prevention measures such as sealing, covering, spraying, etc. shall be taken during mechanical picking and cleaning operations at the construction site. 

  Article 13 In addition to complying with the relevant provisions of Article 11 of these Measures, the demolition of buildings (structures) in the urban planning area shall also adopt dust-proof measures such as water spraying, spraying, and spraying to clean up waste in time. Where blasting is used for demolition, the building (structure) shall be wetted with internal and external watering, spraying, etc. before blasting, and dust-proof measures shall be taken immediately after blasting. 

  After the demolition project of the building (structure) is completed, the bare site shall be covered, and dust prevention measures such as greening and paving shall be taken if the bare site is left for more than three months. 

  For buildings (structures) that have not been completely demolished or whose construction period is more than one month, the on-site construction garbage shall be removed, and dust-proof measures such as enclosure and cover shall be adopted. 

  Article 14 The construction of municipal facilities and urban roads, in addition to complying with the relevant provisions of Article 11 of these Measures, shall meet the requirements of paragraph 1 of Article 12 of these Measures, and shall also comply with the following dust-proof requirements : 

  (1) When carrying out road excavation, cutting, crushing and other operations, dust prevention measures such as water spraying and spraying shall be adopted; 

  (2) Construction shall be carried out by means of section excavation and section backfill; 

  (3) For the trenches that have been backfilled, dust prevention measures such as covering and sprinkling shall be taken; 

  (4) After the completion of various pipeline laying projects in roads or green spaces, the roads shall be restored or greening shall be implemented in time. 

  Article 15 Landscaping operations shall meet the following dust-proof requirements: 

  (1) Planting soil, spoiled soil, surplus soil, etc. generated during the construction process should be removed immediately if the project is located on the main road section, and removed on the same day if the project is located on the general road section; 

  (2) For planting street trees, if the tree hole dug cannot be planted within 48 hours, the planting soil and tree hole shall be covered and watered to prevent dust; 

  (3) The tree pit after planting should be covered with pebbles, sawdust, baffles, etc.; 

  (4) When greening on both sides of the road, the central isolation zone, and the sub-vehicle zone, the edge of the backfill should be more than 5 cm lower than the curbstone; 

  (5) Other dust pollution prevention and control measures prescribed by laws, regulations and rules. 

  The construction of large-scale landscaping projects such as parks and squares shall not only comply with the provisions of the preceding paragraph, but also comply with the relevant provisions of Article 11 of these Measures. 

Article 16 The construction of roads outside the urban planning area shall meet the following dust-proof requirements: 

  (1) Based on seasonal characteristics and different construction stages, formulate and implement corresponding special plans for the prevention and control of construction dust pollution, and make dynamic adjustments; 

  (2) The roads transporting earth and materials to the main operation area of ​​the linear project shall be hardened and dust-proof measures such as watering shall be taken; 

  (3) When performing construction operations that are prone to dust, such as crushing or cutting piles, water spraying and other dust prevention measures shall be taken; 

  (4) Lime, mortar, asphalt concrete, etc. are mixed in the factory, and roadbed fillers and construction materials stacked on site shall be sprayed with water, covered and other dust-proof measures; 

  (5) The road construction ancillary yard (station) shall be implemented in accordance with the requirements for dust prevention of material storage yards in this method; 

  (6) Other dust pollution prevention and control measures prescribed by laws, regulations and rules. 

  The construction of water conservancy projects shall be carried out with reference to the provisions of the preceding paragraph. 

  Article 17 A place where materials prone to fugitive dust are stacked shall meet the following dust-proof requirements:

  (1) Divide the material area and the road boundary, remove scattered materials in time, and keep the material storage area and road tidy; 

  (2) The site is hardened and cleaned and cleaned in time; 

  (3) Fences, wind-proof nets and other facilities higher than the stockpiled materials shall be arranged around the material storage yard, and dust-proof measures such as covering and spraying shall be adopted; 

  (4) For open-air loading and unloading operations, water spraying and other dust-proof measures shall be adopted. For operations using enclosed conveying equipment, dust-proof facilities such as dust collection and spraying shall be provided at the loading and unloading places, and the dust-proof facilities shall be kept in normal use; 

  (5) The exit should be hardened on the ground and equipped with vehicle cleaning and cleaning facilities, and the vehicle can be driven out after being washed; 

  (6) Simultaneously install video monitoring equipment and online dust pollution monitoring equipment, and network with the monitoring equipment of the ecological environment department and other departments responsible for the supervision and management of dust pollution prevention and control to ensure the normal operation of the system. Repair within four hours; 

  (7) Other dust pollution prevention and control measures stipulated by laws, regulations and rules. 

  No unit or individual is allowed to pile up dust-prone materials within urban roads and public places without authorization. 

  Article 18 In addition to complying with the relevant provisions of Article 17 of these Measures, the material storage yard of an industrial enterprise shall also comply with the technical specification requirements for the control of dust pollution from the industrial material storage yard and the relevant regulations on production safety and occupational health. Storage of dust-prone powder or granular materials such as coal powder, fly ash, iron powder, quicklime, cement, cement clinker, slag, silica, slag, etc., shall be stored in a shed or warehouse in a closed manner. Encourage the use of sheds and warehouses for closed storage of block materials. 

  Article 19 The stacking, loading and unloading and transportation operations at the wharf shall meet the following dust-proof requirements: 

  (1) The main roads and auxiliary roads should be paved or hardened, the scattered materials should be removed in time by wet mechanized cleaning, and dust-proof measures such as water spraying should be taken; 

  (2) The open-air storage yard shall set up fences, wind-proof nets and other facilities higher than the stockpiled materials, and adopt dust-proof measures such as covering and spraying; 

  (3) For stacking, reclaiming, unloading (vehicle), and loading (vehicle) operations, the height of the falling material shall be lowered, and wet operations shall be adopted to ensure that the spraying and spraying facilities effectively cover the dust collection area; 

  (4) Dust prevention measures such as airtightness and dust collection shall be adopted for the material conveying belt; 

  (5) The dumping machine room, unloading tunnel, dock surface, and transfer station shall be equipped with hydraulic washing equipment or vacuum cleaning facilities to keep the ground clean and tidy; 

  (6) Set up transport vehicle cleaning facilities at the exit, and the vehicle can be driven out after being cleaned; 

  (7) Other dust pollution prevention and control measures stipulated by laws, regulations and rules. 

  Article 20 The mining and processing of mineral resources shall meet the following dust-proof requirements: 

  (1) The equipment used in the exploration, mining and beneficiation operations should be equipped with dust collection and other dust reduction facilities; 

  (2) The roads in the mining area and the transportation channels from the mining area to the processing area, waste storage yard, and road network shall be hardened, and water spraying and other dust-proof measures shall be taken; 

  (3) Peripheral rock discharge operation shall be given priority for rock discharge, and dust prevention measures such as wet spray shall be adopted during operation; 

  (4) Tailings ponds, dumps, and rock dumps shall adopt dust prevention measures such as spraying covering agents, covering dust nets, greening, and reclamation; 

  (5) For land used for mining, sand quarrying, quarrying and other minerals and soil borrowing that is out of service, an ecological restoration plan shall be formulated and implemented to restore ecological vegetation in a timely manner; 

  (6) The processing of mineral resources shall adopt dust prevention and dust removal measures; 

  (7) The mining and processing area of ​​mineral resources shall simultaneously install video monitoring equipment and online monitoring equipment for dust pollution, and network with the monitoring equipment of the ecological environment department and other departments responsible for the supervision and management of dust pollution prevention and control to ensure the normal system Operation, failure should be repaired within 24 hours; 

  (8) Other dust pollution prevention and control measures stipulated by laws, regulations and rules. 

  Article 21 The bare ground in cities and towns shall be protected from dust such as greening, permeable paving, ground hardening or covering. For construction land that cannot be started temporarily, the bare ground shall be covered; if it exceeds three months, dust prevention measures such as greening and paving shall be adopted. 

  People's governments at all levels should establish bare ground control lists, clarify the patch areas, geographic coordinates, quantity, and area of ​​bare ground, implement dust prevention units and persons responsible, establish and improve a greening responsibility system, and prevent dust pollution. 

  Encourage and guide agricultural producers to adopt measures such as stubble and no-tillage to reduce bare farmland. 

  Article 22 Urban roads shall be cleaned and maintained in a timely manner in accordance with regulations, and the pavement shall be kept tidy and clean, and shall meet the local quality standards for city appearance and environmental sanitation operations. In road sections prone to dust and unfavorable weather conditions, cleaning efforts should be increased and the frequency of watering should be increased. 

Urban roads shall adopt low-dust mechanized wet cleaning operations for dust reduction or washing. If manual cleaning is used, low-dust operations shall be carried out in accordance with the operation specifications. Garbage generated by cleaning and sludge generated by sewage dredging operations shall be cleaned and transported on the same day and shall not be accumulated on roads. 

  Article 23 The important arterial road sections around the city shall adopt mechanized cleaning methods and cooperate with manual cleaning to ensure that there is no dust in the cleaning operation and basically no floating soil on the road surface. If the road surface is severely damaged, measures such as restricting the passage of heavy vehicles or restricting the speed of motor vehicles shall be adopted to prevent and control dust pollution, and timely repair. 

  Operators engaged in catering, accommodation, repair and other industries on both sides of national, provincial, and county roads shall adopt dust-proof measures such as watering and cleaning within the scope of their sanitation contract to prevent and control dust pollution. 

  Article 24 Vehicles that transport coal, garbage, muck, sand, gravel, earthwork, mortar and other materials that are prone to generate dust and pollutants, shall meet the following dust prevention requirements: 

  (1) Install and use satellite positioning systems and driving recorders that comply with national standards in accordance with the law, and keep the number plates clear; 

  (2) Construction waste and engineering dregs transportation vehicles shall hold the approval documents issued by the competent department of urban management; 

  (3) When passing restricted areas or road sections, the vehicle shall carry the pass certificate issued by the traffic management department of the public security organ, and pass according to the prescribed time, area, route, and speed; 

  (4) The load shall not exceed the height of the carriage baffle, and complete airtight measures shall be taken to prevent materials from being scattered, dripped or scattered; 

  (5) The vehicle can be driven out of the work site only after the mud has been cleaned and washed, and the vehicle body should be kept tidy; 

  (6) Other dust pollution prevention and control measures prescribed by laws, regulations and rules. 

  For freight trains passing and stopping in our province, effective dust-proof measures shall be taken to prevent materials from being scattered and scattered. 

  Article 25 Where dust-proof nets are required to cover in accordance with these measures, the density of dust-proof nets shall meet the requirements, and effective wind-proof reinforcement measures shall be taken. For dust-proof nets covering bulk materials, the mesh density shall not be less than 800 mesh/100 square centimeters; for dust-proof nets covering granular, powdery materials and bare ground, the mesh density shall not be less than 2000 mesh/100 square centimeters. 

  The dust-proof net shall be kept intact, and damaged shall be repaired or replaced in time. 

  When constructing or stacking materials within 200 meters on both sides of the railway, dust prevention measures such as shed, warehousing, hardening, greening, spraying of dust suppressants shall be adopted. If dust-proof nets must be used, they shall be set up in accordance with regulations and cleaned up in time Idle and discarded dust nets.

Chapter III Supervision and Administration

  Article 26 The competent department of ecological environment shall reasonably set up dust reduction monitoring points, strengthen the monitoring of fugitive dust pollution, incorporate information related to fugitive dust pollution into the air pollution source monitoring network, and regularly release information on fugitive dust pollution. 

  The competent department of ecological environment and other departments with the responsibility of the supervision and management of the prevention and control of dust pollution shall establish and improve the information sharing and joint prevention and control mechanism of the prevention and control of dust pollution to improve the effectiveness of supervision. 

  Article 27 The people’s governments at or above the county level shall incorporate the emergency response measures for the prevention and control of dust pollution into the emergency response plan for heavy pollution weather, and take corresponding emergency response measures for the prevention and control of dust pollution under special weather conditions such as haze and strong winds.   During the early warning period of heavy pollution weather or when windy weather conditions of level 4 or higher occur, in addition to emergency rescue, the construction unit shall stop operations that may cause dust pollution, such as demolition, blasting, and earthwork. 

  Enterprises, institutions and other producers and operators shall cooperate with the emergency response measures taken by the local government and relevant departments in the severely polluted weather. 

  Article 28: The competent department of ecological environment and other departments responsible for the supervision and management of dust pollution prevention and control shall conduct inspections on enterprises, institutions and other producers and operators in accordance with their pollution prevention and control level, emission intensity, enterprise management level, and transportation methods. Evaluation and performance classification, implementation of differentiated management and control of emergency emission reduction. 

  Encourage enterprises, institutions and other production operators to take seasonal production control measures in light of the production characteristics of the industry and its impact on air quality. 

  Article 29 The competent department of ecological environment shall, together with other departments responsible for the supervision and management of dust pollution, investigate the source of dust, establish a corresponding pollution source database, determine and timely adjust the key dust pollution sources in the administrative area, and report to the society every month.   The standards and procedures for determining key dust pollution sources shall be formulated by the provincial ecological environment department in conjunction with relevant departments. 

  Article 30 The competent department of ecological environment and other departments responsible for the supervision and management of fugitive dust pollution prevention and control shall exercise key supervision over key fugitive dust pollution sources. 

  Key units responsible for dust pollution sources shall install and use online dust pollution monitoring equipment and supporting facilities, and network with the monitoring equipment of the competent department of ecological environment, and truthfully disclose information on dust pollution discharge to the society in accordance with the law, and accept social supervision. Online monitoring equipment should operate normally, and must not be destroyed, damaged, dismantled or left unused without authorization, and must not tamper or forge monitoring data. 

  Article 31 The competent department of the ecological environment and other departments responsible for the supervision and management of dust pollution prevention and control can conduct on-site inspections, automatic monitoring, remote sensing monitoring, drone inspections, far-infrared cameras, etc., to deal with enterprises and institutions that produce dust pollution. Supervise and inspect with other producers and operators. 

  The units and individuals under inspection shall actively cooperate, truthfully report the situation, and timely provide materials related to the inspection, and shall not refuse, obstruct or avoid the inspection. 

Article 32 Any unit or individual has the right to discourage, complain and report on the behavior of dust pollution. 

  The competent department of ecological environment and other departments responsible for the supervision and management of dust pollution prevention and control shall publish complaint and report telephone numbers, e-mail addresses, etc., accept, investigate, and handle complaints and reports in accordance with the law, give feedback on the results in a timely manner, and serve as complainants and informants Keep confidential and safeguard the legitimate rights and interests of complainants and informants. 

  The competent department of ecological environment and other departments with the responsibility of the supervision and management of dust pollution prevention and control may hire dust pollution prevention and control supervisors to strengthen social supervision of the prevention and control of dust pollution. 

  Article 33 The competent department of ecological environment and other departments responsible for the supervision and management of dust pollution prevention and control shall strengthen the construction of a credit system, establish and improve trustworthy incentives and punishment mechanisms for untrustworthiness. Those with outstanding achievements in the prevention and control of dust pollution shall be included in the trustworthy list. Optimize inspection methods in daily supervision and reduce the frequency of random inspections; those with serious dust pollution will be included in the list of untrustworthy, as key supervision objects, increase the frequency of inspections, and strengthen on-site inspections. 

  Article 34 Establish a green credit system. The provincial ecological environment department shall regularly and uniformly provide the People’s Bank with information on environmental violations of enterprises that produce dust pollution in the province; the People’s Bank shall enter the enterprise’s environmental violation information into the corporate credit investigation system as an important basis for loan approval. 

  Article 35: In areas where the prevention and control of dust pollution is not adequately carried out, the supervision responsibility is not in place, and the dust pollution is serious, the provincial ecological environment department will meet with the relevant departments to discuss the main person in charge of the local people's government, and open the interview to the public Happening. 

  Article 36: For cases of violations of the law, such as strong public feedback and major dust pollution, the higher-level government and its department responsible for the supervision and management of dust pollution prevention and control shall list the lower-level government and the department responsible for the supervision and management of dust pollution prevention and control Supervise, investigate and rectify within a time limit, and disclose the supervision status to the public. 

  Article 37 People's governments at or above the county level shall conduct assessments on the dust pollution prevention and control work of the people's governments at lower levels, incorporate the assessment results into the assessment content of the ecological environmental protection target responsibility system, and make them public.

Chapter IV Legal Liability

  Article 38. If the people’s governments at all levels, the competent departments of ecological environment and other departments responsible for the supervision and management of dust pollution control fail to perform their duties in accordance with the provisions of these Measures, the relevant organs shall order corrections, and the directly responsible persons in charge and other directly responsible The responsible person shall be punished according to law; if a crime is constituted, criminal responsibility shall be investigated according to law. 

  Article 39 In violation of the provisions of these Measures, the construction unit fails to perform the main responsibility for the prevention and control of dust pollution in the construction project, and the discharge of dust pollutants does not meet the standards, the supervision and management department shall order corrections and impose a fine of 10,000 to 30,000; the circumstances are more serious. If it is serious, a fine of 30,000 yuan up to 100,000 yuan shall be imposed; if it refuses to make corrections, it shall be ordered to stop work for rectification. 

  Article 40 In violation of the provisions of these Measures, if effective measures are not taken in accordance with the law to prevent and control dust pollution in construction, material stacking, terminal operations, mining and processing of mineral resources, the supervision and management department shall order corrections and impose a fine of 10,000 yuan to 30,000 yuan ; If the circumstances are more serious, a fine of 30,000 yuan up to 100,000 yuan shall be imposed; if they refuse to make corrections, they shall be ordered to stop work and stop production for rectification. 

  Article 41 In violation of the provisions of these Measures, transportation of coal, garbage, muck, sand, gravel, earth, mortar and other materials that are prone to dust pollution and failing to take effective measures to prevent and control dust pollution in accordance with the law shall be ordered by the supervision and management department to correct and impose a punishment of 2,000 A fine of not less than RMB 5,000 but not more than RMB 5,000; if the circumstances are serious, a fine of not less than RMB 5,000 but not more than RMB 20,000 shall be imposed; if correction is refused, the vehicle shall not be driven on the road. 

  Article 42 If the construction unit refuses to take emergency measures for the prevention and control of fugitive dust pollution in violation of the provisions of these Measures, and stops operations such as demolition, blasting, earthwork, etc., the supervision and management department shall order immediate corrections and impose a fine of 10,000 yuan up to 100,000 yuan. . 

  Article 43 In violation of the provisions of these Measures, enterprises, institutions and other producers and operators identified as key dust pollution sources commit one of the following acts, the supervision and management department shall order corrections within a time limit and impose a fine of 20,000 to 50,000 yuan If the circumstances are serious, a fine of 50,000 yuan to 100,000 yuan shall be imposed; if the circumstance is serious, a fine of 100,000 yuan but not more than 200,000 yuan shall be imposed; if the circumstances are not corrected, the work shall be suspended for rectification: 

  (1) Failing to install and use online monitoring equipment for dust pollutants in accordance with regulations, or failing to network with the monitoring equipment of the competent department of ecological environment in accordance with regulations, and to ensure the normal operation of the monitoring equipment;

  (2) Destroying, damaging or dismantling or leaving idle the online monitoring equipment for dust pollutants without authorization; 

  (3) Failure to disclose monitoring data in accordance with the law, or tampering with or falsifying monitoring data. 

  Article 44 In violation of the provisions of these Measures, if one of the following circumstances is imposed and a fine is imposed, the person who is ordered to make corrections and refuses to make corrections may be punished continuously on a daily basis according to the original penalty amount from the day after the day the correction is ordered: 

  (1) Failing to adopt dust pollution prevention and control measures in construction and construction; 

  (2) Failing to take prevention and control measures for dust pollution in material stacking; 

  (3) Failing to take measures to prevent and control dust pollution in the mining and processing of mineral resources; 

  (4) Exceeding the emission standards of fugitive dust pollutants. 

Chapter 5 Supplementary Provisions

  Article 45 The dust pollution mentioned in these Measures refers to the construction of construction projects, the demolition of buildings (structures), decoration, material transportation, material stacking, landscaping, road maintenance and cleaning, mining and processing of mineral resources, docks Air pollution caused by activities such as operations and dust particles generated by exposed land. 

  Article 46 These Measures shall come into force on April 1, 2020.
