  The Regulations on the Administration of Small Passenger Ship Transportation of Hebei Province were adopted at the 50th Executive Meeting of the Provincial Government on April 2, 2019. They are hereby announced and will come into force on June 1, 2019.

Article 1 of the Regulations on the   Administration of Small Passenger Ship Transportation of Hebei Province

  is to regulate the operation of small passenger ships, maintain the order of the waterway transportation market, ensure the safety of waterway passenger transportation, and promote the healthy development of the waterway transportation industry. According to the "Domestic Waterway Transportation Management Regulations" and relevant laws and regulations The regulations are formulated in accordance with the actual conditions of the province. 

  Article 2 Those engaged in small passenger ship transportation operations within the navigable waters of this province shall abide by these regulations. 

  The navigable waters mentioned in these regulations refer to the lakes, wadian lakes, reservoirs, canals and other inland river waters recognized by the competent department of coastal waters and waterway transportation of this province as navigable for ships. 

  The small passenger ship mentioned in these regulations refers to a ship approved to carry 12 passengers or less for passenger transportation. 

  Article 3 The transportation department of the Provincial People's Government is in charge of the administration of waterway transportation in the whole province. The competent water transport department of the people's government at the districted city and county level is responsible for the management of small passenger ship transportation within its administrative area. 

  The relevant departments of the people's governments at or above the county level, such as natural resources, water conservancy, culture and tourism, and ecological environment, shall do a good job in the management of small passenger ships within their respective responsibilities. 

  The township (town) people's government, sub-district offices, and various development (park) district management agencies shall assist the waterway transportation authorities and other relevant departments in the management of small passenger ships. 

  Article 4 The transportation of small passenger ships shall adhere to the development direction of safety and convenience, green, low-carbon, and high-quality. Encourage and protect fair competition, and prohibit monopoly and unfair competition. 

  People's governments at or above the county level shall use economic and technical policies to support and encourage large-scale and intensive operation of waterway transportation, and gradually eliminate ships with high energy consumption and high pollution. Green and environmentally friendly ships shall be used for small passenger ships in the navigable waters of nature reserves and wetland reserves. 

  Article 5 The people's government of a city or county level divided into districts shall, based on the relevant functional zoning of navigable waters and the actual development of the waterway passenger transportation market, scientifically plan the docking stations for small passenger ships and delimit special parking areas for small passenger ships. 

  Article 6 Operators engaged in the transportation of small passenger ships (hereinafter referred to as operators) shall register as market entities in accordance with the law, and file with the local waterway transportation authority after obtaining a business license. The following information or materials shall be submitted for filing: 

  (1) The market entity registration information of the operator; 

  (2) Information on small passenger ships engaged in business; 

  (3) Information on crew and other business management personnel; 

  (4) Routes and stops; 

  (5) Management systems for safety production responsibility system and pollution prevention and control. 

  If the above information or materials can be obtained through government information, the waterway transportation department shall not require the operator to submit it repeatedly. If the information and materials submitted by the operator or obtained through the government information are complete, the waterway transportation department shall issue a written filing receipt on the spot. 

  Article 7 Small passenger ships engaged in business operations shall obtain ship registration and inspection certificates issued by the competent waterway transportation department in accordance with the law, and be equipped with corresponding safety equipment such as life-saving and fire fighting. 

  Article 8 The crew of small passenger ships engaged in business operations shall hold a crew qualification certificate issued by the competent department of water transport in accordance with the law. 

  Article 9 The operator shall provide services to passengers in accordance with the registered routes and stops, and shall not change without authorization; if the change is really necessary, the change shall be filed with the waterway transportation department; if the change or cancellation is temporarily due to force majeure, the passenger shall be arranged Change to another voyage or refund the ferry fee. 

  Article 10 Operators shall abide by laws and regulations such as water pollution prevention and control, nature reserve management, wetland protection, etc., maintain the environment of the waters where ships sail and berth, and shall not discharge or dump wastes and pollutants illegally. 

  Article 11 Operators shall strengthen risk management and purchase relevant liability insurance for small passenger ships and passengers. 

  Article 12 The operator shall explain or warn passengers the following matters in a clear manner: 

  (1) Groups and persons who are not suitable for boarding; 

  (2) Methods of using relevant facilities and equipment correctly; 

  (3) Necessary safety precautions, emergency measures and safety and life-saving knowledge; 

  (4) Inflammable, explosive, toxic and harmful dangerous goods that are prohibited from being carried; 

  (5) Other situations that may endanger the safety of ship navigation, the personal health of passengers, and the safety of life and property. 

  Article 13 The competent department of waterway transportation shall incorporate small passenger ship transportation into the overall waterway transportation emergency plan, and regularly organize operator drills. Operators should implement the main responsibility for safe production, establish and improve a safe production management system, and strictly implement it. 

  Article 14 The competent department of water transportation shall formulate service quality specifications for small passenger ships in accordance with relevant national standards, and guide operators to improve transportation safety and service quality. 

  Operators should formulate operating norms and service standards, and strengthen professional ethics education and business training for employees. 

  Article 15 The competent department of waterway transportation shall regularly carry out statistical investigation and analysis of the waterway transportation market, form a report on the supply and demand status of the waterway transportation market, and publish it to the public to provide a reference for operators to rationally adjust the shipping capacity. 

  Operators shall submit statistical information to the competent department of waterway transportation in accordance with statistical laws and regulations. 

  Article 16 The competent department of waterway transportation shall, in conjunction with relevant departments, establish and complete a system of supervision, inspection, and co-inspection and notification of small passenger ship transportation, promptly investigate and punish illegal acts of small passenger ship transportation, and jointly maintain order in the waterway transportation market. 

  Article 17 The competent department of water transportation shall establish and improve a social supervision mechanism for illegal operations of small passenger ships, publish the telephone number and mailbox of complaints and reports, and timely accept and process complaints and reports and feedback the results of handling. 

  Article 18 The competent department of waterway transportation shall establish integrity files of operators, and record the illegal acts, handling results, safety liability accidents, etc., found during supervision and inspection or acceptance of complaints and reports into the integrity files. 

  Article 19: State personnel in charge of waterway transportation management who abuse their power, neglect their duties, or engage in malpractice for personal gains in waterway transportation management activities shall be punished according to law; if a crime is constituted, criminal responsibility shall be investigated according to law. 

  Article 20 If an operator violates these regulations and commits one of the following acts, the waterway transportation department shall order it to make corrections within a time limit; if it fails to make corrections within the time limit, a fine of between RMB 2,000 and RMB 5,000 shall be imposed: 

  (1) Changing or canceling routes or stops without authorization; 

  (2) Failure to purchase relevant liability insurance for small passenger ships and passengers; 

  (3) Failure to expressly explain or warn passengers about the safety matters specified in Article 12. 

  Article 21 Business operators who violate these regulations and commit one of the following acts shall be punished by the competent department of water transportation according to law: 

  (1) Small passenger ships engaged in business have not obtained valid registration certificates and inspection certificates in accordance with the law, and are not equipped with corresponding life-saving and fire-fighting safety equipment; 

  (2) The crew of a small passenger ship engaged in business does not hold the corresponding crew qualification certificate in accordance with the law. 

  Article 22 The transportation of small passenger ships in urban garden waters shall be managed with reference to these regulations. 

  Article 23 These regulations shall come into force on June 1, 2019.
